This Privacy Policy ("Privacy Policy") is intended to inform you about how we use and disclose information collected during your visits to our website and in messages we exchange with you ("Communications"), and it applies only to information collected through our website. We do not control, endorse, or make any representations about these third-party websites or their privacy practices, which may differ from ours.

If you provide us with Personal Data regarding other individuals, you declare that you have the authority to do so and declare that you have obtained the necessary consent to authorize the use of such information in accordance with this Privacy Policy.

1. Glossary

1.1 For the purposes of this Privacy Policy:

"Personal Data": any information that, directly or indirectly, identifies or can identify a natural person, such as name, CPF (Brazilian individual taxpayer number), date of birth, IP address, among others;

"Sensitive Personal Data": any information that reveals, in relation to a natural person, racial or ethnic origin, religious beliefs, political opinions, membership in a trade union or religious, philosophical, or political organization, data related to health or sexual life, genetic or biometric data;

"Processing of Personal Data": any operation carried out with Personal Data, whether by automated means or not, such as collection, recording, organization, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination, or alternatively, provision, alignment or association, restriction, erasure, or destruction. Processing of Personal Data also includes any other operation provided for under applicable law;

"Data Protection Laws": all legal provisions regulating the Processing of Personal Data, including, but not limited to, Brazil’s General Data Protection Law (LGPD - Law No. 13.709/18).

2. Use of Personal Data

2.1 We collect and use Personal Data to manage your relationship with Plenatech and to better serve you when you are using the website, personalizing, and enhancing your experience. Examples of how we use the data include:

Registering users on our website;

Sending information that we believe is of interest to you;

Personalizing your website usage experience; and

Contacting you via provided phone number and/or email address for support, issue solution, and, when necessary, for reasonable business purposes such as sending promotional information about Plenatech products or services or those of our partners. In this case, if the User wishes, they may request the removal or alteration of their personal data by sending an email to dpo@plenatech.com

2.2 Additionally, the Personal Data provided may also be used in the manner we deem necessary or appropriate:

(a) in accordance with Data Protection Laws;

(b) to comply with legal obligations or demands of judicial process;

(c) to comply with a court order, regulatory decision, or decision of legal authorities, including authorities outside the country of residence;

(d) to enforce our Terms of Use;

(e) to protect our operations;

(f) to protect our, your, or third-party rights, privacy, safety;

(g) to detect and prevent fraud;

(h) to enable us to use available remedies or limit damages we may incur; and

(i) in other ways permitted by law.

3. Non-provision of Personal Data

3.1 You are not obligated to share Personal Data or register to browse our website; however, if you choose not to share them, in some cases, we may not be able to provide you with full access to the website.

4. Data Collected

4.1 Anyone may browse our website without the need for any registration or submission of Personal Data. However, some features of the site may depend on registration and submission of Personal Data.

4.2 When contacting us, Plenatech may collect:

(i) Contact information. Name, e-mail, phone number; and

(ii) Submitted information. Information you send via forms (questions, complaints, suggestions, criticisms, compliments, etc.).

4.3 During general website navigation, Plenatech may collect:

(i) Location data. Geolocation data when you access the site;

(ii) Preferences. Information about your preferences and interests regarding the site (when you tell us what they are or when we deduce them from what we know about you) and how you prefer to receive our Communications;

(iii) Website browsing data. Information about your visits and activities on our site, including the content (and any ads) you view and interact with, information about the browser and device you are using, your IP address, your location, and the website address from which you arrived. Some of this information is collected using our Automated Data Collection Tools, which include cookies, web beacons, and embedded web links. 4.4 We do not collect Sensitive Personal Data.

5. Sharing of Personal Data with third parties:

5.1 Plenatech may share your Personal Data:

(i) With the partner company(s) you select or choose to send your data, questions, inquiries, etc., as well as with service providers or partners to manage and/or support certain aspects of our business operations on our behalf. These service providers or partners may be located in the United States, Brazil, or other global locations, including servers for testing and production, and providers of data hosting and storage services, customer support, sales on our behalf, order fulfillment, content customization, advertising and marketing activities (including digital and personalized advertising), and IT services, for example;

(ii) With third parties, to assist us in managing the website; and

(iii) With third parties, in the event of any reorganization, merger, sale, joint venture, assignment, transfer, or conveyance of all or part of our company, assets or capital (including those related to bankruptcy or similar proceedings).

7.2 This information may be about you, your preferences, or your device and is mainly used to make the Platform work as you expect. The information generally does not directly identify you but can provide a more personalized internet experience.

7.3 In accordance with this Privacy Policy and the Cookie Policy, we and our third-party service providers, with your consent, may collect your Personal Data in various ways, including, among others:

7.3.1 Through the browser or device: Some information is collected by most browsers or automatically through devices that access the internet. Such data includes computer type, screen resolution, operating system name and version, device model and manufacturer, language, type, and version of the internet browser you are using. We may use this information to ensure that the website functions properly.

7.3.2 Use of cookies: Information about your use of the website may be collected by third parties through cookies. Cookies are information stored directly on the computer or device you are using. (vi) deletion of Personal Data processed with your consent, to the extent permitted by law;

(vii) information about the entities with which your Personal Data have been shared;

(viii) information about the possibility of not giving consent and about the consequences of refusal; and

(ix) withdrawal of consent. Your requests will be treated with special care to ensure the effectiveness of your rights. You may be asked to provide proof of your identity to ensure that the sharing of Personal Data is only done with its owner.

8.2 Bear in mind that, in certain cases (for example, due to legal requirements), your request may not be immediately fulfilled, and Plenatech may not be able to comply with it due to legal obligations.

9.1 We seek to adopt the technical and organizational measures provided by Data Protection Laws applicable to the protection of Personal Data in our organization. Unfortunately, no transmission or data storage system can guarantee to be 100% secure. If you have reason to believe that your interaction with us has become insecure (for example, if you believe that the security of any of your accounts has been compromised), please notify us immediately. 

10. Links to Other Websites and Social Networks

10.1 Our website may, from time to time, contain hypertext links that will redirect you to websites that belong to our partners, advertisers, suppliers, etc. If you click on any of these links that take you to these websites, please note that each website has its own privacy practices, and we are not responsible for these policies. Please refer to the respective policies before submitting any Personal Data to these websites.

10.2 We are not responsible for the policies and practices of collection, use, and disclosure (including data protection practices) of other organizations, such as Facebook, Apple, Google, Microsoft, or any other software developer or application provider, social media platform, operating system, wireless internet service provider, or device manufacturer, including all Personal Data you disclose to other organizations through applications, related to such applications, or published on our social media pages. We recommend that you familiarize yourself with the privacy policy of each website visited or each service provider used.

11. Use of the Website by Minors

11.1 The website is not intended for individuals under the age of 18 (eighteen), and we ask that such individuals do not provide us with any personal data.

12. Updates to this Privacy Policy

12.1 If we modify our Privacy Policy, we will publish the new text on the website, with the updated revision date. We may change this Privacy Policy at any time. If there is a significant change to the terms of this Privacy Policy, we may inform you through the contact information we have in our database or through a notification on our website.

12.2 We remind you that we are committed to not processing your Personal Data in a manner inconsistent with the objectives described above, except as otherwise required by law or court order.

12.3 Your use of the website after policy changes means that you have accepted the revised Privacy Policies. If, after reading the revised version, you do not agree with its terms, please discontinue access to the site.
